If an engagement terminates
within five weeks insight will select and present replacement applicants,
this will, of course be treated with the utmost urgency. Upon appointment
of the replacement applicant a full credit will be issued for the original
fee and a new invoice presented for the replacement.
The refund guarantee can also come into operation if the client does not
wish to pursue the replacement service or insight are unable to present
a suitable replacement. Temporary to permanent contracts do not qualify
for either the refund or replacement guarantee. |

1 The agency means insight recruitment.
2 The client means the person, company or corporate body to whom the applicant
is introduced.
3 The applicant means the person introduced by the agency to the client.
4 The engagement means the employment of the applicant to the client.
5 These terms and conditions are deemed to be accepted by the client registering
the requirement, either verbally or written, when he interviews an applicant
or, if no interview takes place, when he engages such an applicant.
6 The client is requested to inform the agency either verbally or in writing
immediately upon engagement of an applicant with full details of employment
and remuneration package.
7 The client is contracted out to pay the agency's fee for the introduction
of the applicant within 30 days from the invoice date. The fee for the introduction
of permanent staff will be calculated at the current rate and is a percentage
of the commencing annual salary. In the event the applicant is solely entitled
to commission or bonus payments the agency reserves the right to estimate
the equivalent salary when calculating the fee. VAT is payable at the prevailing
rate. If payment of the agency fee remains overdue (whether wholly or in
part) the client will pay thereafter interest on the outstanding amount
at the rate 2.5% per month. Such interest will accrue from day to day.
8 If the engagement terminates within two weeks there will be no fee, providing
that written notification is received within seven days of the employment
terminating. Should the engagement terminate within ten weeks of the applicant
starting work, either by the applicant (not having good cause) or by the
client by reason of unsuitability of the applicant for the job for which
they were employed then the client would be allowed a refund of 10% of the
engagement fee each completed week not worked. No refund credit or replacement
shall be allowed in any case unless within seven days of the termination
notification is received in writing and payment has been received within
30 days from invoice date.
9 The introduction of applicants by the agency is confidential. If the client
engages a candidate within 6 months of the introduction without notification
to the agency, or if the client discloses to any third party any information
about an applicant who has been introduced by the agency and as a result
the third party engages the applicant within 6 months of the agency's introduction.
The client shall thereupon be liable to pay the current agency fee.
10 The agency and its employees shall accept no liability whatsoever for
any damage, delay, expense or loss which the client, its servants, agents,
customers or others may suffer or become liable out of or in connection
with, or as a result of the introduction to the client or the engagement
by the client of the candidate.
11 Whilst the agency endeavour to ensure the suitability of their applicants,
the agency will not be held responsible for any loss, damage or expense
suffered by the client arising from an introduction. It is the client's
responsibility for obtaining and checking references in relation to the
applicant and for satisfying himself as to the applicant's skills and suitability.
The client is also responsible for obtaining work permits wherever necessary.

1 The agency means insight
recruitment.
2 The client means the person, business or corporate body requiring the
service of the temporary worker.
3 The temporary worker means the person introduced by the agency and engaged
by the client for assignment.
4 The assignment means the period during which the temporary worker is engaged
by the client via the agency.
5 The engagement of a temporary worker supplied by the agency is deemed
acceptance of the agency's terms and conditions.
6 The fees payable to the agency by the client shall be at an hourly rate
or at the current scales of charges of the agency and shall be advised to
the client at the time of the engagement of the temporary worker. These
charges are subject to change from time to time as advised by any subsequent
letter. These fees shall be calculated on the basis of all hours worked
together with any additional charge agreed between the agency and the client.
All fees are subject to VAT.
7 Payment by the client is against the agency's weekly invoice which is for settlement 7 days from the invoice date and without deduction of any kind.
8 In the event of an engagement by the client of a temporary worker supplied by the agency either directly or pursuant to being supplied by another employment business, within either:
·1 The duration of the assignment, or
·2 14 weeks from the start of the assignment (the first assignment being each new assignment where there has been a break of more than 42 days (6 weeks) since the end of the previous assignment), or
·3 8 weeks from the day the temporary worker worked on the assignment the client shall be liable, to either:
a) Subject to electing upon giving 5 working days notice, an extended period of hire for a minimum of 26 continuous weeks, where the client shall pay the charges as referred to in clause 6 for each hour the temporary worker is so employed, or
b) A Transfer Fee calculated at 17% of the annual salary or if the remuneration is not known, the hourly charge multiplied by 200. No refund will be paid in the event that the engagement subsequently terminates. All fees are subject to VAT.
9 In the event that there is an introduction of a temporary worker to the client which does not result in the supply of that temporary worker by the employment business to the client, but which leads to an engagement by the client of the temporary worker either directly or pursuant to being supplied by another employment business within 6 months the client shall be liable, to either:
a) subject to electing upon giving 5 days notice, a period of hire of 26 weeks during which the agency shall be entitled to the charges as referred to in clause 6 for each hour the temporary worker is so employed or supplied; or
b) an Introduction Fee calculated at 17% of the annual salary or if the remuneration is not known, the hourly charge multiplied by 200. No refund will be paid in the event that the engagement subsequently terminates. All fees are subject to VAT.
10 In the event that the temporary worker supplied to a client is introduced by the client to a third party which results in the engagement of the temporary worker by the third party within either:
- The duration of the assignment, or
- 14 weeks from the start of the first assignment (the first assignment being each new assignment where there has been a break of more than 42 days (6 weeks) since the end of the previous assignment, or
- 8 weeks from the date after the last day the temporary worker worked on the assignment,
the client will be liable to pay a Transfer fee calculated at 17% of the annual salary or if the remuneration is not known, the hourly charge multiplied by 200. No refund will be paid in the event that the engagement subsequently terminates. All fees are subject to VAT.
11 n the event that there is an introduction of a temporary worker to the client which does not result in the supply of the temporary worker by the agency to the client but the temporary worker is introduced by the client to a third party which results in the engagement of the temporary worker by the third party with 26 weeks from the date of introduction the client shall be liable to an introduction fee calculated at 17% of the annual salary or if the remuneration is not known, the hourly charge multiplied by 200. No refund will be paid in the event that the engagement subsequently terminates. All fees are subject to VAT.
12 The re-engagement of a temporary worker by the client on a permanent, self employed, freelance or temporary basis, through the auspices of an outside agent, during the period of a temporary assignment arranged by the agency shall make the client liable for payment to the agency of the normal engagement fee (17% of the annual salary)
13 At all times during the assignment the temporary worker shall be an employee of the agency who shall be responsible for payment of all wages, national insurance and other contributions required by law to paid by an employer.
14 If the temporary worker for any reason proves to be unsatisfactory the client must immediately inform the agency by telephone. No charge will be made provided the client notifies the agency within 4 hours of the temporary worker reporting for duty and ceases to use the temporary worker. The agency will endeavour to provide a suitable replacement immediately or advise accordingly.
15 The agency and it employees shall accept no liability whatsoever for any damage, delay, expense or loss which the client, its servants agents, customers or others may suffer or become liable out or in connection with the provision of a temporary worker, or the acts or omissions of the agency and its employees or any failure to provide a temporary worker for all parts of the period for which they were hired and the client will indemnify the agency in full against any such liability and any costs and expenses.
16 The client is responsible for providing adequate insurance whilst a temporary worker is under the client’s direction and control, to the extent that any temporary worker and the agency have full benefit of coverage for any liability, which might arise. Temporary workers are under the direction and control of the clients for the duration of their assignment.
